Only country to have a successful motion of no-confidence be unsuccessful

first_imgDear Editor,The term “no-confidence” motion is not an alien term to me. I pursued (and completed) a political science degree at York University. During my time there the then Prime Minister Steven Harper faced a No-Confidence Motion which led to early elections.A No-Confidence Motion is not unique to Guyana’s Constitution. It is in all parliamentary democracies, as a method to keep the Government in check. Britain, from where we inherited our Constitution, saw Margaret Thatcher, then Leader of the Opposition, bring a motion of no-confidence on March 28, 1979. She won by a single vote, and they held elections on May 3, 1979, thirty-seven (37) days after the motion passed.Canada in 2011 saw a motion of no-confidence passing on March 25, and elections were held on May 2, thirty-nine (39) days later. It should be noted that the Prime Minister actually prorogued Parliament twice before returning and finally facing the No-Confidence Motion.In the year 2018, we saw multiple motions of no-confidence brought forward. Greece kicked off the show on January 16, 2018, however, their Government was able to withstand the motion of no-confidence. Spain’s motion was brought on May 25, 2018, debated on May 31 and June 1 – the Government resigned June 5. In a matter of four days, the Spanish Government faced the consequences of falling to a motion of no-confidence. Sweden’s Prime Minister lost a vote of no-confidence on September 25, 2018, and immediately complied with the Constitution. He was eventually confirmed on January 18, 2019, as the Prime Minister again. Sri Lanka, on November 14, 2018, elections held January 5, 2019. Sri Lanka’s Government, after fifty-three (53) days, complied. Guyana saw her motion of no-confidence in the year of no-confidence and the consequences are still to be faced.Just this year, the Austrian Chancellor (Head of Government) was voted out of office by a motion of no-confidence on May 27, (2019). On May 28, a caretaker Government was appointed and elections were scheduled for September 29, 2019.The motion of no-confidence was brought to Parliament two hundred and eighty-five (285) days ago, debated and passed two-hundred and forty-nine (249) days ago. This was the first time a motion of no-confidence was filed and debated on by National Assembly. The Government decided to challenge its legality on three different fronts and after a myriad of court cases, it was determined that the motion was successful. Seventy (70) days have now elapsed since the Caribbean Court of Justice ruled that to the motion of no-confidence carried.Guyana seems to be the only country to have a successful motion of no-confidence be unsuccessful.Regards,Nalinie Singhlast_img read more

Farmer, excavator operator on bail for canal showdown

first_imgTagenarine Lalman and Sanjay Kumar of Middlesex, Canal Number Two, West Bank Demerara, appeared before Wales Magistrate Rushell Liverpool on allegations that they threatened and verbally abused each.According to the facts of the case, Kumar, a 21-year-old excavator operator, made use of threatening behaviour towards Lalman and his wife, Lakshmi Lalman on March 4, 2018 at Middlesex.Represented by Attorney Pamela De Santos, Lalman, a 41-year-old farmer, was counter-charged with using abusive language toward Kumar. The court was told that Lalman was never charged before and Kumar lives with his parents. The excavator operator was released on $30,000 bail for allegedly threatening the husband and wife, while Mr Lalman was granted $15,000 on his charge. Welder charged for attempting to kill stepfather

first_imgA welder who allegedly stabbed his stepfather during an argument was remanded to prison on Thursday when he appeared at the Georgetown Magistrates’ Courts.Joel Persaud of Lot 16 Public Road, Little Diamond, East Bank Demerara, stood before Magistrate Ann McLennan. The charge stated that on June 16, 2019, at Little Diamond Public Road, with intent to commit murder, he wounded George Jones.Joel PersaudThe prosecution is contending that on June 16, Persaud asked his mother for some food and she refused, causing him to become annoyed.According to the prosecution’s case, the man became abusive towards his mother, which led his stepfather, who was at home at the time, to intervene. During an argument, Persaud allegedly dealt Jones several stabs. Jones was rushed to the Georgetown Public Hospital Corporation (GPHC), where he was admitted and remains a patient.In court on Thursday, Persaud proceeded to tell the court that on the day in question, he was eating when he got chopped to his back with a cutlass by his stepfather. He stated that he began to run to his neighbour’s residence when he fell down. The man stated that the police were summoned and they took him to the hospital. He furthered claimed that he did not sign any statement.Police Prosecutor Gordon Mansfield said that the Virtual Complainant is in a serious condition and, therefore, he should not be released on bail. The prosecutor noted that three witnesses, who reside at the same address as Persaud, have given statements against the accused.After listening to the Prosecutor’s submission, Magistrate McLennan remanded the man to prison. TRIAL UNABLE TO GO AHEAD BECAUSE OF LACK OF JURORS

first_imgLegal history was made in the county for the first time this week – for all the wrong reasons.Judge Donagh McDonaghIt is believed that for the first time a criminal trial could not go ahead in a Donegal court because not enough jurors were available to proceed. On Tuesday at Letterkenny Circuit Court, two trials were preparing to get underway before Judge Donagh McDonagh.A total of 28 people turned up to serve their civic duty on the jury panel.There are normally a lot more present when a jury panel in selected.Both the prosecution and defence teams are both entitled to make unspecified objections of jurors prior to the panel being sworn in.They successfully reached 12 jurors for the first trial but between the remaining members of the jury panel, coupled with six juror challenges, they had only reached six jurors after the procedure for the second case. WOMAN FIGHTS FOR LIFE AFTER HORRIFIC ROAD CRASH

first_imgA WOMAN is in a critical condition after a road traffic accident in the county today.The Letterkenny to Lifford Road has been closed around 1km on the Letterkenny side of Rossgeir following the incident.A number of vehicles were involved in the crash which gardai believe was caused by an oil spill. Ambulance and fire crews are still at the scene.A number of vehicles have left the road.
